BROOKLYN PARK, Minn. – Nov. 28, 2012– The United States Court of Appeals for the Federal Circuit, in a recently published opinion, unanimously affirmed a previous ruling by the United States District Court for the District of Minnesota rejecting a claim by Icon Health and Fitness, Inc., that several of Octane Fitness’s elliptical exercise machines infringed upon two of its patents – one directed to an electronics control system and the other directed to a stride adjust mechanical linkage.
“We were totally surprised by this accusation from Icon,” said Dennis Lee, president and CEO of Octane Fitness, LLC (www.octanefitness.com). “We honor and respect the legitimate patent rights of others and perform substantial due diligence to ensure that our products do not infringe upon other patents. In this case, we always have believed that Icon’s suit was baseless and without merit. Our victory here confirms and strengthens our commitment to aggressively defend against unjustified allegations of patent infringement.”
Octane currently makes five traditional standing ellipticals for home workouts and four for commercial use; in addition to five seated ellipticals for home use and three for commercial; and the new LateralX lateral elliptical trainer.
“Octane will proudly continue to innovate, protect our technology with patents and vigorously defend our intellectual property,” Lee added.
